Section 1 Scope of Application

(1) These General Terms and Conditions (hereinafter: GTC) apply to all contracts concluded between us, LH10 GmbH, registered at the District Court of Bremen 36620 HB, VAT ID: DE341130786, represented by the Managing Director Theo Bührmann

and contracts concluded with you as our customer. They apply to private individuals (consumers) as well as to entrepreneurs, legal entities under public law, or special funds under public law within the meaning of Section 310 (1) of the German Civil Code (BGB).

(2) These General Terms and Conditions apply in particular to accommodation contracts for the rental of the agreed hotel room or apartment with the agreed amenities (hereinafter referred to as "accommodation") for the agreed duration of stay, as well as all services provided to you in this context at the respective hotel.

(3) The version of the General Terms and Conditions valid at the time of contract conclusion shall apply.

§ 2 Conclusion of Contract

(1) By booking accommodation, you are offering to enter into an accommodation contract with us. The booking is only concluded once your request (offer) is accepted by us, LH10 GmbH. This occurs only upon our express acceptance by sending a booking confirmation via email. Until the booking confirmation is sent, our offers are subject to change and are non-binding. We may refuse to enter into an accommodation contract with you at our own discretion.

(2) You have no entitlement to the provision of a specific accommodation or to the fulfillment of special requests that go beyond the provision of accommodation. You are only entitled to the provision of accommodation within the room category you have booked.

(3) If a third party has booked on your behalf, they shall be liable to us together with you as joint and several debtors for all obligations arising from the accommodation contract.

§ 3 Reservation, Cancellation, Non-utilization of Accommodation

(1) The term "cancellation" as used below refers to your withdrawal from the accommodation contract. The term "arrival date" refers to the first day of the booking period. The term "departure date" refers to the corresponding last day of the booking period.

(2) You may withdraw from the accommodation contract before the arrival date. The withdrawal must be made in text form. To comply with the text form requirement, the cancellation must be sent, for example, via email to hallo@lh-hotels.de. The time at which we receive your declaration is decisive for meeting the deadlines.

(3) If you withdraw from the accommodation contract, the following cancellation deadlines apply:

a)Flexible rate: You may cancel free of charge until 3:00 p.m. two days before the arrival date. Example: For an arrival on Friday, cancellation is free of charge until Wednesday at 3:00 p.m. For later cancellations, we will charge a cancellation fee of 90% of the room rate for the first night booked. All subsequent nights booked will be cancelled free of charge.

b) Non-refundable rate If you have booked a discounted rate marked as "non-refundable," free cancellation is not possible. In this case, we will charge a cancellation fee of 90% of the total booked price.

(4) The deduction of saved expenses is accounted for in section 3.3 above. You are free to prove that the aforementioned claim did not arise or did not arise to the extent claimed.

(5) If you do not check in on the day of arrival, the reservation will be cancelled without replacement, and the reserved accommodation will be made available for sale again. You will no longer have any claim to the provision of accommodation. This situation constitutes a "no-show" as defined in the preceding sections.

§ 4 Arrival and Departure

(1) We will make the accommodation in the agreed room category and with the agreed amenities available to you from 4:00 p.m. on the day of arrival. You have no entitlement to earlier access to the accommodation.

(2) You will receive an access code via email once payment has been received, which will allow you to enter the hotel and your accommodation. You will only receive the booking confirmation after full payment for your stay has been made.

(Booking confirmation).

(3) On the day of departure, you must vacate your accommodation and return it in an undamaged condition by 10:00 a.m. at the latest. Direct bookers receive a late check-out at 11:00 a.m. (subject to availability and confirmation).

If our cleaning staff requests that you check out and you fail to vacate the room, we may charge you 100% of the previous day's room rate for the unauthorized continued use of the room. You are permitted to prove that we incurred no loss or significantly less loss; we reserve the right to refute such claims.

(4) Early check-in or late check-out may be arranged upon request. Such arrangements are subject to availability and an additional fee. There is no entitlement to these services.

(5) Extending your stay beyond the period agreed in the accommodation contract is only possible after prior, timely consultation with us. This consultation should take place at least before half of the stay period has elapsed and requires confirmation from us in text form. The confirmation is considered an extension of the contract within the meaning of the accommodation agreement. There is generally no entitlement to an extension.

§ 5 Terms of Use

(1) Use of the accommodation by persons other than those specified in the reservation is prohibited. The maximum occupancy for the respective room category must not be exceeded. Children aged three and over count as adults.

(2) The resale, sub-letting, or brokering of the booked accommodation is prohibited unless otherwise expressly agreed in writing.

(3) You are obligated to observe our house rules during your stay at the hotel. You can find the house rules in your room.

(4) It is prohibited to consume tobacco products (in particular cigarettes, cigars, pipes) and tobacco or smoking substitute products (in particular e-cigarettes) in the accommodation. In the event of a violation, we reserve the right to charge you for the (basic) cleaning costs resulting from the unauthorized consumption or to set a flat rate ("liquidated damages"). In the event of a flat-rate charge, you are free to prove that the actual costs incurred were lower.

§ 6 Accommodation Prices and Other Charges

(1) You are obligated to pay the agreed accommodation price. This constitutes the consideration for the provision of the accommodation by us. A full accommodation price is charged per night, regardless of actual use or occupancy.

(2) The agreed prices apply.

(3) The prices shown include the applicable value-added tax as well as all statutory taxes, fees, and charges, unless expressly stated otherwise.

§ 7 Payment Terms

(1) Accommodation prices are due for payment in advance when booking via the websites booking.com and airbnb.de.

(2) When booking via the website lh-hotels.de, the accommodation price is paid using the payment provider Stripe.

(3) You will pay the accommodation price using Stripe.

(4) You may only assert rights of set-off and retention if the underlying counterclaims are undisputed or have been legally established.

§ 8 Host Liability

(1) In all cases of contractual and non-contractual liability, we are liable to you for damages or compensation for wasted expenditure in the event of intent and gross negligence in accordance with statutory provisions.

(2) In other cases, unless otherwise stipulated below, we shall only be liable for the breach of a contractual obligation whose fulfillment is essential for the proper execution of the contract and upon whose compliance you as a customer may regularly rely (a so-called cardinal duty), limited to the compensation of foreseeable and typical damages. In all other cases, our liability is excluded, subject to the provisions in paragraph 3.

(3) Our liability for damages resulting from injury to life, limb, or health, as well as under the Product Liability Act and applicable data protection regulations, remains unaffected by the above limitations and exclusions of liability.

(4) Where our liability is excluded or limited under the aforementioned provisions, this also applies to our vicarious agents.

(5) Should any disruptions or defects occur in our services, you must report them immediately. Upon becoming aware of them or upon your immediate complaint, we will endeavor to provide a remedy. You are obligated to contribute what is reasonable for you to resolve the disruption and keep any potential damage to a minimum.

(6) We are liable for items brought into the hotel in accordance with statutory provisions.

§ 9 Theft and Damage

In the event of theft or damage to your belongings, as well as in the event of fire, water damage, or any other damage in the accommodation, you must immediately inform the hotel staff via the 24/7 telephone number displayed in the rooms and do everything reasonable to assist in clarifying the theft or remedying the damage.

§10 Obligations and Liability of the Guest

(1) You must treat the accommodation and any items provided, as well as shared rooms and facilities, with care and ensure that the use of other rooms or communal areas is not impaired; this applies in particular to noise disturbances.

(2) We have sole domiciliary rights in all rooms and on the premises.

(3) You are liable to us for the full replacement value (same or equivalent item, new price, new equipment, new furniture) for all damage to the rooms, furnishings, equipment, and facilities provided for your use that arises from negligent, grossly negligent, and/or intentionally harmful use or treatment by you. The same applies to all damage caused by you to other (communal) rooms, furnishings, equipment, and facilities. Obligations regarding the use of the premises are also set out in the house rules.

§ 11 Pets

(1) In principle, pets are not permitted.

(2) In exceptional cases, you may bring a dog as a guest. If you wish to do so, you are required to disclose this at the time of booking. If we approve the presence of a dog, this is subject to the condition that the dog is under the constant supervision of the guest, is free of disease, and does not otherwise pose a danger to guests or staff. It is forbidden to allow the dog on the bed. A maximum of one dog is permitted per room, unless otherwise agreed in an individual contract.

(3) A fee of €30 per booking is charged for bringing a dog.

(4) Should excessive cleaning be required due to the dog (e.g., heavy soiling of textiles due to hair, etc.), we are entitled to charge you for the additional effort.

§ 12 Special Grounds for Termination of the Accommodation Contract

We are entitled to terminate the accommodation contract, in particular if, during your stay at the hotel, you are under the influence of illegal drugs, use the accommodation for commercial activities involving customer traffic, use the accommodation for prostitution, or repeatedly insult hotel staff or other hotel guests despite being warned.

§13 General Provisions

(1) Amendments and supplements to the accommodation contract, the acceptance of the application, or these General Terms and Conditions must be made in text form. Unilateral amendments or supplements by you are invalid.

(2) The law of the Federal Republic of Germany applies.

(3) The place of performance and payment is the registered office of the company in Bremen. If a contractual partner meets the requirements of Section 38 (2) of the German Code of Civil Procedure (ZPO) and does not have a general place of jurisdiction in Germany, the place of jurisdiction shall be Bremen. However, we are also entitled to bring legal action and other judicial proceedings at your general place of jurisdiction.
